SHOW CAUSE ORDER

This refers to the letter complaint of Bernard M. Peralta received by this Office from the National Council on Disability Affairs on 18 May 2010 against your establishment for the alleged refusal to grant 20% discount to persons with disability for the purchase of medicines.

Chapter 8, Section 32 [c] of RA 7277 as amended by RA 9442 in relation to Section V (5) as implemented by Section VI (4) of AO 2009-0011 provides that persons with disability shall be entitled to at least twenty percent [20%] discount for the purchase of medicines in all drugstores for the exclusive use or enjoyment of persons with disability.

IN VIEW THEREOF, you are a given a period of (15) days from receipt hereof to show valid cause in writing as to why no administrative action should be taken against you and your establishment for the aforesaid violation. In the event of your failure to do so, judgment by default will be rendered against you and the case shall be decided based on the evidence on record.

The DOH-Center for Health Development No. IV-A, QMMC Compound, Project 4, Quezon City, is hereby requested to cause the service of this Order and to submit a report thereof to the FDA-LICD.
